Nike, one of the world's largest sportswear brands, is now the subject of a formal federal investigation by the Equal Employment Opportunity Commission (EEOC). The probe centers on allegations that the company's DEI initiatives may have resulted in discrimination against white employees.
What Happened
The EEOC disclosed the investigation in a motion filed in Missouri federal court, demanding Nike fully comply with a subpoena for information about its internal diversity programs. The agency is examining whether Nike's "2025 Targets" and other DEI-related objectives led to discriminatory practices in hiring, mentoring, and career development opportunities.
According to court documents, the EEOC is seeking Nike's criteria for selecting employees for layoffs, how it tracks and uses worker race and ethnicity data, and information about programs that allegedly provided race-restricted mentoring and leadership opportunities.
How It Started
The investigation did not originate from a worker complaint. Instead, EEOC Commissioner Andrea Lucas filed her own complaint in May 2024 using a rarely-invoked tool known as a "commissioner's charge." This came after America First Legal, a conservative legal group founded by top Trump adviser Stephen Miller, sent the EEOC a letter urging the agency to investigate Nike's DEI programs.
Nike's Response
In a statement, Nike said the company has worked to cooperate with the EEOC and called the subpoena "a surprising and unusual escalation." The company has not publicly commented on the specifics of its DEI programs under scrutiny.
